The Catalan Consumer Agency, of the Department of Business and Labor, has opened 85 disciplinary proceedings against real estate companies that are large homeowners, for breach of the obligation provided for in Law 24/2015 on urgent measures to deal with to the emergency in the field of housing.
Of the disciplinary proceedings opened by Consum, 6 have already been resolved with a sanction for a serious infraction in accordance with the Law of the Consumer Code of Catalonia, with fines of 25,000 euros for each case.
In the inspection procedure, Consum has detected infringements for not documenting the offer of rehousing of people or families in a situation of vulnerability, before evicting them for non-payment of rent or mortgage. Inspection controls to comply with Law 24/2015, remain open for what I remind you:
Article 5
Article 5 of Law 24/2015 states that natural or legal persons who are large holders and financial institutions, investment funds and asset management entities, must offer a social rent to tenants before any eviction , in accordance with the level of income provided for in the same Act.
Income level
Individuals and family units are at risk of residential exclusion as long as they have an income of less than 2 times the IRSC, in the case of people living alone, or an income of less than 2.5 times the IRSC, in the case of cohabitation units, or an income of less than 3 times the IRSC, in the case of people with disabilities or high dependency. If the income is more than 1.5 times the IRSC, a social services report is required to prove the risk of residential exclusion.
