Yesterday, Sunday, the BOE published Royal Decree Law 11/2022, of June 25, by which certain measures are adopted and extended to respond to the economic and social consequences of the war in Ukraine, to deal with situations of social and economic vulnerability, and for the economic and social recovery of the island of La Palma, among which we highlight:
Extraordinary limitation of the annual update of the income of housing lease contracts
The lessee of a housing rental contract subject to Law 29/1994, of November 24, on urban leases whose rent must be updated so that the corresponding annual validity is fulfilled within the period between the entry into force of this Royal Decree Law (27/06/22) and on December 31, 2022, will be able to negotiate with the landlord the increase that will be applied in this annual update of the rent, subject to the following conditions:
a) In case the lessor is a large holder, the increase in income will be the result of the new agreement between the parties, without it being able to exceed the result of applying the annual variation of the Competitiveness Guarantee Index on the date of this update, taking as the reference month for the update the one that corresponds to the last index that was published on the date of the contract update. If there is no new agreement between the parties, the increase in income remains subject to this same limitation.
For the purposes of this article, a natural or legal person who is the owner of more than ten urban properties for residential use or a constructed area of more than 1,500 m2 of residential use, excluding all case garages and storage rooms.
b) If the lessor is not a large holder, the increase in rent will be the result of the new agreement between the parties. In the absence of this new agreement between the parties, the increase in income cannot exceed the result of applying the annual variation of the Competitiveness Guarantee Index as of the date of this update, taking as the reference month for to the update which corresponds to the last index that was published on the contract update date.
Entry into force
This Royal Decree-Law enters into force the day after publication in the Official State Gazette, today, June 27.
